What is the difference between a Dynamic Market, DPS and Open Framework?

Dynamic Markets, Dynamic Purchasing Systems and Open Frameworks are all flexible public sector buying routes that allow suppliers to access opportunities beyond traditional “closed” frameworks.

A Dynamic Market is a new commercial tool introduced under the Procurement Act 2023. It allows suppliers to apply to join during the lifetime of the agreement, provided they meet the conditions of membership.

A Dynamic Purchasing System, or DPS, is the pre-Procurement Act predecessor to a Dynamic Market. Many DPSs are still live and remain open to new suppliers.

An Open Framework is a framework that can be reopened to new suppliers at set points during its lifetime, rather than being closed to new entrants for the full term.

For suppliers, the key practical difference is how and when you can join. Dynamic Markets and DPSs are generally open throughout their lifetime, while Open Frameworks are reopened periodically.

Are suppliers still able to join Dynamic Purchasing Systems?

Yes. Many public sector Dynamic Purchasing Systems are still live and remain open for suppliers to join. Although Dynamic Markets are replacing DPSs under the Procurement Act 2023, existing DPSs can continue to operate during their remaining term.

Suppliers should check whether a DPS is still accepting applications, when it is due to expire, which buyers are using it, and whether contracts are actually being awarded through it.

Are Dynamic Markets replacing DPSs?

Dynamic Markets are the new 2023 Procurement Act route-to-market that replaces the role previously played by Dynamic Purchasing Systems. Both are designed to give public sector buyers access to a pool of qualified suppliers, while giving suppliers a route to join after the agreement has launched.

However, DPSs have not disappeared overnight. Many DPS agreements remain live under the old procurement regulations, and will continue to exist until their naturally expire. Some authorities erronously name newly created Dynamic Markets as 'Dynamic Purchasing Systems', despite them no longer existing under the incumbent regulations.

What are the benefits of Dynamic Markets and Open Frameworks for suppliers?

Dynamic Markets and Open Frameworks can give suppliers more flexibility than traditional closed frameworks.

The main benefit is access. On a closed framework, suppliers normally have to win a place at the start and may be locked out for several years if they miss the application window. Dynamic Markets can remain open throughout their lifetime, and Open Frameworks can reopen at scheduled points.

This means suppliers may have more chances to enter public sector routes to market, respond to future call-offs, and compete for work in sectors such as technology, construction, health and social care, facilities management, consultancy, housing, and skills and training.

How should suppliers decide which DPS, Dynamic Market or Open Framework to join?

Suppliers should not rely only on the projected value of an agreement. Projected call-off values can be useful for understanding the theoretical size of an opportunity, but they do not show how much money has actually been spent through the agreement.

Before applying, suppliers should assess:

  • Whether relevant buyers are actively using the agreement;

  • How many contracts have been awarded through it;

  • Which suppliers are already winning work;

  • Whether the agreement covers their products or services;

  • When the agreement expires;

  • Whether the likely opportunity is large enough to justify the application effort.

Why can projected framework values be misleading?

Projected framework values are estimates set by the framework provider. They usually represent the maximum potential value of work that could be awarded through the agreement, not the value that has actually been awarded.

This means a framework, DPS, Dynamic Market or Open Framework can appear very large on paper but generate limited real contract activity. The opposite can also happen: a smaller-looking agreement may be heavily used by relevant buyers in a supplier’s target market.

Suppliers should therefore compare projected value with real call-off activity before deciding whether an agreement is worth pursuing.
